Terms of Service

These Terms of Service ("Terms") are an agreement between you and Different Productions LLC ("Liminal Wallet," "we," "us," or "our") covering your use of the Liminal Wallet application for iPhone, iPad, and Mac (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who can use the App

You must be at least 18 years old and located in the United States. The App is offered only in the United States at this time.

2. What the App does

Liminal Wallet connects to your financial accounts through Plaid and shows your accounts, balances, transactions, investments, and insights drawn from them. Your bank connections are also subject to Plaid's terms and privacy policy at plaid.com/legal.

3. It is not financial, investment, tax, or legal advice

The App is for information and personal money management only. It does not give financial, investment, tax, accounting, or legal advice, and nothing in it should be relied on as advice. Balances, categories, net-worth totals, recurring-bill predictions, and every other figure are estimates built from third-party data, and they may be incomplete, delayed, or wrong. Your financial decisions are yours. Talk to a qualified professional before making them, and verify balances and transactions with your bank.

4. No warranty on the data or the service

The App depends on data supplied by third parties, including Plaid and your financial institutions, and on services we do not control. We do not warrant that the data shown is accurate, complete, current, or available, and we do not guarantee uninterrupted or error-free operation. Bank connections can break, lag, or need you to sign in again. The App is provided "as is" and "as available," with no warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows.

5. Subscription, free trial, and billing

Liminal Wallet Pro is an auto-renewing subscription:

• Plans: monthly or yearly. Both sit in one App Store subscription group, so switching between them takes effect at the next renewal.
• Price: shown in the App and on the App Store product page, in US dollars, before you buy.
• Free trial: new subscribers get 30 days free where Apple confirms you are eligible for the introductory offer. Eligibility is decided by Apple, and the App states the offer only when Apple has confirmed it. If you do not cancel at least 24 hours before the trial ends, it becomes a paid subscription and you are charged.
• Auto-renewal: billing runs through your Apple App Store account. The subscription renews automatically unless you cancel at least 24 hours before the current period ends. Apple charges your account within 24 hours before each renewal.
• Managing and canceling: manage, switch, or cancel in the App Store — on iOS, Settings, your name, then Subscriptions. Deleting your account in the App does not cancel your subscription. Only Apple can cancel it, and we cannot cancel or refund an Apple-billed subscription for you.
• Refunds: purchases are handled by Apple, and refunds follow Apple's policies.
• Price changes: we may change the price. Any change applies to future billing periods and, where required, only with notice and your consent, under Apple's rules.

Your license to the App is governed by Apple's Licensed Application End User License Agreement at apple.com/legal/internet-services/itunes/dev/stdeula, unless we provide a custom agreement. Apple is a third-party beneficiary of these Terms and may enforce them.

6. Acceptable use

You agree not to:

• Use the App unlawfully, or in breach of these Terms, Apple's terms, or Plaid's terms.
• Access or try to access accounts or data that are not yours, or supply credentials you are not authorized to use.
• Reverse engineer, decompile, disassemble, or tamper with the App, except where the law allows it.
• Interfere with, disrupt, overload, or try to gain unauthorized access to the App, our backend, or any connected service.
• Use the App to build a competing product, or to scrape, resell, or redistribute data obtained through it.

7. Your account and your device

You are responsible for the security of your device and your Apple ID, and for everything done under your account. Tell us promptly at support@liminalwallet.app if you suspect someone else has access.

8. Ownership

The App — its software, design, and content, excluding your financial data and third-party data — is owned by Different Productions LLC and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use, under these Terms and Apple's standard license agreement.

9. Limitation of liability

To the fullest extent the law allows, Different Productions LLC and its owners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the App — including any reliance on data shown in it — even if we were advised such damages were possible. To the fullest extent the law allows, our total liability for all claims relating to the App will not exceed the greater of what you paid us in the twelve months before the claim or fifty US dollars ($50.00). Some jurisdictions do not allow certain limits, so parts of this may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Different Productions LLC and its owners from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your misuse of the App or your breach of these Terms or of the law.

11. Ending it

You may stop using the App and delete your account at any time: open Settings, choose Delete Account, and confirm. We may suspend or end your access if you breach these Terms, if the law requires it, or if we discontinue the App. Sections that by their nature should survive — 3, 4, 8, 9, 10, and 13 — survive.

12. Changes to these Terms

We may update these Terms. We will revise the "Last updated" date and, for material changes, give notice in the App or by email. Continuing to use the App after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction — except where the law prohibits it, and without limiting any rights Apple requires us to preserve for you.
